Market Street Press Code of Conduct

This Code of Conducts applies to all manufacturers and their subcontractors manufacturing products for Market Street Press. The contractor or broker will be held responsible for the actions of the manufacturer they choose.

In addition, manufacturers are required to comply with all applicable legal requirements in the country of manufacture. Where there are differences or conflicts between this Code and the laws of the country of manufacture, the higher standard shall prevail.

Market Street Press values and appreciates full honesty to ensure a strong relationship. The present requirements of this Code of Conduct may require time to be achieved. Market Street Press understands this situation and will help the factory to become genuinely involved in reaching our goals.

Worker's rights

Manufacturers must recognize and respect the right of employees to freedom of association and collective bargaining in a lawful and peaceful manner and without any disciplinary action, penalty or interference.

Manufacturers must respect each employee with dignity and respect and provide a work environment free of sexual, psychological, verbal or other harassment, physical abuse, intimidation and corporal punishments.

Manufacturers shall make the contents of this Code of Conduct available to any and all of their employees and subcontractors in a language they can understand. Manufacturers will post this Code of Conduct in a prominent spot so that employees can read it, or if employees cannot read, the manufacturer will have it read to them.

Discrimination

No employee shall be subject to any discrimination in employment, including recruitment, salary, benefits, working conditions, advancement, discipline or termination, on the basis of gender, color, race, religion, age, sexual orientation, nationality, political opinion, social or ethnic origin.

Women workers shall receive equal remuneration, benefits, treatment, evaluation and opportunities. Manufacturers must comply with local laws regarding maternity leave and pregnancy benefits. Workers who take maternity leave will not face dismissal nor threat of dismissal, loss of seniority or deduction of wages, and will be able to return to their former employment at the same rate of pay and benefits.

Forced labor

Manufacturers will not use forced labor in any form, including prison, indentured, bonded labor or otherwise, nor shall workers required to lodge “deposits” or their identity papers with their employer.

Child labor

Manufacturers shall not employ any person at any time below the age of 16 years old or younger than the age for completing compulsory education in the country of manufacture where such age is higher than 16. This includes no child labor during the summer when children are on summer vacation.If a child is found working at a facility that makes MSP products, the broker or manufacturer working with Market Street Press will be responsible for paying for that child to attend school until they are of a legal working age.

Wages and benefits

Manufacturer shall pay employees, as a floor, at least the minimum wage required by local laws or the prevailing industry wage, whichever is higher and shall provide all the legally mandated benefits.

Wages shall be paid directly to the employee in cash, check, or the equivalent and no deductions for disciplinary measures will be applied. Manufacturer shall provide a written account for every period to the employees in a form they understand. Employees shall be paid for overtime hours at such premium rate as is legally required in the country of manufacture or, in countries where such laws do not exist, at a rate at least equal to their regular hourly compensation rate.

Working hours

Manufacturers shall ensure that the regular work schedule is not more than 48 hours per week and does not exceed 70 hours per week, including overtime, and 12 hours in a given day. Employees shall be allowed at least 24 consecutive hours off per week (1 full day) and should receive paid annual leave according to the local laws.

Health & safety

Manufacturers shall provide a safe and healthy working environment, including protection from fire, unnecessary accident, and toxic substances. Lighting, heating and ventilation systems should be adequate

Employees should have access at all time to sanitary facilities and potable water which should be adequate and clean.

The same standards should apply to residential facilities when they are provided to employees.

Environment

Manufacturer shall comply with all applicable environmental laws in the country of manufacture. Market Street Press will work with manufacturers that actively preserve and protect the natural environment by such means as energy conservation and reduction, proper disposal and recycling of wastes.

Material Use

Manufacturers shall be honest in disclosing all information regarding the materials and methods used in manufacturing Market Street Press products.

Manufacturers will allow testing on their products to check for material composition at any time.

Right of review

Manufacturers shall maintain all documentation to demonstrate compliance with this Code of Conduct. Accuracy and transparency of records are considered as a part of “maintaining” the documentation.

Manufacturers allow Market Street Press and/or any of its representatives or agents unrestricted access to its facilities and to all relevant records at all time, whether or not notice is provided in advance.
